Rep. Tim Reisch & RINOs Hate the Constitution! Kill Parental Rights Bill SB113
I like this title. I am uncompromising regarding fundamental parental rights and the Constitution of the United States. Sadly, Representative Tim Reisch feels that the 14th Amendment Due Process Clause is no good.
In the 1925 case Pierce v. Society of Sisters, the Supreme Court famously stated that "the child is not the mere creature of the State," emphasizing parental rights in directing their children's education and upbringing.
ONE hundred years later, I listened to the SD House of Representatives argue over this straightforward bill. It was embarrassing, actually. These people took an oath to uphold the Constitution, but when faced with it, they wanted it amended. The 14th Amendment Due Process Clause does not remove the protections of a child (which should be a no-brainer). The United States Supreme Court has defended the rights of parents for over 100 years. Fundamental parental rights are inalienable rights that the government does not give; they are inherent.
Fundamental rights are not Absolute Rights. Parents cannot do whatever they choose. We have codified laws that ensure protection for our children. Children, by law, cannot be abused and neglected. These laws do not change. Fundamental Parental Rights and Child protection laws can co-exist!
Sadly, in today's world, we have witnessed the government and its massive entities encroaching again and again on our rights to raise our children in the manner in which we see fit. Think 2020 forward...less than TWO MONTHS AGO, if you protested at a school board meeting, you might have been labeled a terrorist under the Biden Administration. These same people who stood with Constitutional denier Reisch also:
Stood against parents' rights regarding p@rn in our school libraries
Protections for elders against bullies and abusers when they want to run pipelines through their lands
Traditional marriage of young people
And banned the 10 Ten Commandments in school!
Protecting our children from predators and overzealous
governmental agencies is real.
Understand that DSS and CPS are the reasons ICWA exists. SD DSS is so rogue with power SD Sec Alhtoff signed a LEASE with ZERO legislative oversight that will cost SD taxpayers over 300 million dollars!
SB113 Opposition: DSS/CPS, Education, States Attorneys....consider the last five years and tell me if we need parental rights in our state law. Fundamental Rights = strict scrutiny must be applied.
South Dakota, if we don't wake up, it won't be long before the government actually thinks it can knight itself parent of our kids.
